1. PREAMBLE

The parties agree that purchases made through the online store www.fandlecare.com shall be governed exclusively by this contract, to the exclusion of any previously available conditions on the website.

These general terms and conditions apply to any use and to all orders placed on the website www.fandlecare.com and its respective addresses (hereinafter referred to as www.fandlecare.com). By placing an order, you confirm that you accept these terms of sale, which shall prevail over all previous versions or any specifications made by you, including email correspondence.

2. ORDERS

2.1 PRODUCT OFFER
Products are presented in accordance with legal regulations and are described as accurately as possible.

There may be differences between the Products delivered and those displayed on the Website or in the catalog, particularly for Handmade Products, each of which is unique, and Products that have undergone technical or technological modifications. You may not cancel your order or refuse delivery due to such differences, provided they do not affect the essential characteristics or quality of the Products.

We cannot guarantee that the color you see on the website or in catalogs will match the actual product color, as color display depends on your browser and monitor. Fandle Care is not responsible for inaccuracies in website photos.

2.2 ORDER ACCEPTANCE
By confirming your order, you are placing a valid order. The order becomes binding for Fandle Care once payment is validated and the order is registered.

3. PRICE / PAYMENT

3.1 PRODUCT PRICES
Product prices are indicated in euros, including applicable taxes.

3.2 SHIPPING FEES
Products may be delivered by carrier or parcel service. The shipping method will be specified when placing your order.

3.3 PAYMENT
Payment must be made in full at the time of the order: credit card (invoices in English only), gift card, unless otherwise indicated.

Credit card payments are secured through the Payments system, in accordance with international interbank regulations, ensuring secure online transactions. Fandle Care does not store your credit card information.

To combat online fraud, Fandle Care may request verification of banking details or identity before delivery. By placing an order, the customer agrees to provide the necessary information. If no satisfactory response is received within the specified timeframe, Fandle Care reserves the right to cancel the order.

3.4 INVOICING
Invoices are issued based on the information entered in the customer account. Buyers may edit these details when placing an order.

Commercial buyers must contact the BUDGET Department before placing a valid order to arrange the issuance of a commercial invoice. Business customers may provide all necessary details, including their intra-community VAT number.

4. DELIVERY

4.1 DELIVERY METHODS
The shipping method will be specified after the order is placed.

Parcel service delivery: Orders are delivered by express service to your home. Packages are delivered to the entrance of your building. Delivery will occur within a maximum of 10 days from the date indicated on the “availability” page at the time of purchase.

Carrier delivery: Orders are delivered by a specialized carrier with maximum protection.

4.2 ACCEPTANCE AND CLAIMS
Before signing for delivery, you must check for damage, missing items, defects, or non-conformities, including packaging condition and product references.

To file a claim, contact Fandle Care. The claim must include:
– A detailed list of damaged or missing items on the delivery note. General statements such as “subject to unpacking” are insufficient.
– Written notice by email to info@fandlecare.com.

A copy of the complaint must be sent within the same timeframe. You must provide proof and allow inspection.

If accepted, the defective Product will be replaced or refunded if unavailable. Returned Products must be in perfect condition, in original packaging with all accessories. Returns require prior consent from Fandle Care.

5. RETURN POLICY

5.1 Right of Withdrawal
Consumers have the legal right to withdraw from the Contract within 14 days without justification.

The withdrawal period expires 14 days after the User or a third party (other than the carrier) takes physical possession of the goods, or, in the case of multiple deliveries, 14 days after receipt of the last item.

5.2 Contractual Right of Return
The User must inform Fandle Care and return the items within 14 days of delivery.

5.3 Conditions
Returns are not accepted for:
– Personalized items
– Sealed products not suitable for return for hygiene reasons if unsealed

Products must be returned in original condition and packaging. No refund will be issued for used or damaged items.

6. USE OF THE WEBSITE

6.1 INTELLECTUAL PROPERTY
All website content is protected by international copyright laws. No content may be reproduced without prior written authorization.

6.2 USER LIABILITY
Access and use of the website are at your own risk. Fandle Care is not responsible for technical failures, viruses, or damages resulting from access or downloads.

7. FORCE MAJEURE
Neither party shall be liable for failure due to force majeure events (e.g., floods, fires, strikes, shortages). If such events last more than one month, Fandle Care may cancel the order and refund the purchase price.

Email communications and automated systems constitute valid proof.

8.2 SEVERABILITY
If any provision is invalid, remaining provisions remain enforceable.

8.3 NO WAIVER
Failure to exercise rights does not constitute waiver.

8.4 HEADINGS
Headings do not affect interpretation.

8.5 MODIFICATIONS
Fandle Care may modify these terms. The online version at the time of order applies.

8.6 ENTIRE AGREEMENT
These terms and the order summary constitute the entire agreement.

9. PRIVACY POLICY
